Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Flaregun AiR website, applications, and services (collectively, the "Service") provided by Flaregun Inc. ("Flaregun," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@flaregun.ai of any unauthorized use.

2. The Service

Flaregun AiR is an augmented communication platform that lets users anchor digital content to real-world GPS locations ("Channels"). We may update, modify, or discontinue features at any time. Free-tier Channels are temporary and expire after 48 hours; paid Channels remain active subject to your subscription status.

3. Subscriptions, Billing & Refunds

• Billing. Paid plans are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe. You authorize us to charge your payment method for all applicable fees and taxes.
• Auto-renewal. Subscriptions automatically renew at the then-current rate until canceled. You may cancel at any time from your account page; cancellation takes effect at the end of the current billing period.
• Refunds. Except where required by law, fees are non-refundable. We may, at our discretion, offer pro-rated refunds for service outages or billing errors.
• Price changes. We may change pricing with at least 30 days' notice prior to your next renewal.

4. Acceptable Use

You agree not to use the Service to:

• Violate any law or third-party right, including intellectual property, privacy, or publicity rights.
• Post content that is unlawful, harassing, defamatory, hateful, sexually explicit involving minors, or that incites violence.
• Distribute malware, spam, phishing content, or attempt to gain unauthorized access to the Service or other users' accounts.
• Reverse engineer, scrape, or interfere with the operation of the Service.
• Place Channels on private property without permission, or in any location where doing so would violate local law.

We may remove content and suspend or terminate accounts that violate these Terms.

5. User Content

You retain ownership of the content you upload or generate through the Service ("User Content"). You grant Flaregun a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting), publicly display, and distribute your User Content solely to operate and provide the Service. You represent that you have all necessary rights to grant this license.

6. AI-Generated Content

The Service may use third-party AI models to generate images, videos, or other content based on your prompts. You are responsible for your prompts and outputs and for ensuring they comply with applicable law. We do not guarantee accuracy, originality, or fitness for any purpose.

7. Intellectual Property

The Service, including all software, designs, trademarks, and logos, is owned by Flaregun or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

8. Third-Party Services

The Service integrates with third parties (e.g., Stripe for payments, mapping providers, AI vendors). Your use of those services is subject to their terms. We are not responsible for third-party services.

9. Termination

You may delete your account at any time. We may suspend or terminate your access for any violation of these Terms or for any lawful business reason. Upon termination, your right to use the Service ends and we may delete your User Content after a reasonable grace period.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAREGUN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold harmless Flaregun and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Where mandatory consumer law in your jurisdiction provides otherwise, those rights are unaffected.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
